1. About these terms
These Terms of Use set out the terms on which you may access and use the website at https://www.2403group.com (the "Site"), whether as a guest or otherwise. Please read them carefully before you use the Site.
By accessing or using the Site, you confirm that you accept these Terms of Use and agree to comply with them. If you do not agree to these Terms of Use, you must not use the Site.
These Terms of Use govern your use of the Site only. They do not govern the provision of consultancy or professional services by us, which are provided under a separate written agreement between 2403 Group and the client concerned. Where there is any conflict between these Terms of Use and a signed engagement agreement in relation to services, the engagement agreement prevails.
2. Who we are
The Site is operated by 2403 Group ("2403", "we", "us" or "our"), a company registered in the United Arab Emirates under the Meydan Free Zone Authority (MFZA), with its registered address at 2403 Group, Meydan Free Zone Authority (MFZA), 6th Floor, Meydan Grandstand, Meydan Road, Nad Al Sheba 1, P.O. Box 9305, Dubai, United Arab Emirates.

3. Other terms that apply to you
These Terms of Use refer to the following additional documents, which also apply to your use of the Site. Our Privacy Policy sets out how we collect, use and protect personal data, and the rights available to you. Our Cookie Policy sets out how we use cookies and similar technologies on the Site and how you can manage your preferences. By using the Site you consent to the processing described in those documents and you confirm that all information you provide to us is accurate.
4. Changes to these terms and to the Site
We may amend these Terms of Use at any time by revising this page. Any changes take effect from the date they are posted, and the Last Updated date at the top of this page will be revised accordingly. Please check this page from time to time, as your continued use of the Site after a change constitutes acceptance of the amended terms.
We may update, alter, suspend or withdraw all or any part of the Site at any time and without notice. We do not guarantee that the Site, or any content on it, will always be available, uninterrupted or free from error. Access to the Site is permitted on a temporary basis, and we will not be liable to you if the Site is unavailable at any time or for any period.
5. Accessing the Site
The Site is made available free of charge. You are responsible for making all arrangements necessary for you to access the Site, including your own internet connection and devices, and for ensuring that anyone who accesses the Site through your connection is aware of these Terms of Use and complies with them.
We do not represent that the content of the Site is appropriate for, or available in, all locations. If you access the Site from outside the United Arab Emirates, you do so on your own initiative and are responsible for compliance with the laws of your own jurisdiction.
6. Intellectual property rights
We are the owner or the licensee of all intellectual property rights in the Site and in the material published on it, including the text, graphics, layout, design, photographs, video, audio, code and the 2403 name and branding. Those works are protected by copyright, trade mark and other intellectual property laws and treaties. All such rights are reserved.
You may print off one copy, and may download extracts, of any page from the Site for your own internal reference or for the purpose of evaluating our services. You must not modify the paper or digital copies of any materials you have printed or downloaded, and you must not use any illustrations, photographs, video, audio or graphics separately from any accompanying text.
Our status as the authors of content on the Site must always be acknowledged where you use it. You must not use any part of the content on the Site for commercial purposes without first obtaining a licence from us. If you print off, copy or download any part of the Site in breach of these Terms of Use, your right to use the Site ceases immediately and you must, at our option, return or destroy any copies of the materials you have made.
Third-party names, logos and marks appearing on the Site, including those of organisations we have worked with, are the property of their respective owners and are used for identification and reference purposes only. Their appearance does not imply any endorsement of 2403 by, or any current relationship or partnership with, those organisations unless expressly stated.
7. No reliance on information
The content on the Site is provided for general information only. It is not advice, and it is not intended to be relied upon in making, or refraining from making, any decision. It does not constitute professional, legal, financial, tax, investment or technical advice, and it does not create any adviser or client relationship between you and 2403.
Although we make reasonable efforts to keep the information on the Site up to date, we make no representations, warranties or guarantees, whether express or implied, that the content on the Site is accurate, complete, current or free from error. Case studies, portfolio references, capability descriptions and outcome statements describe past work and are not a promise, guarantee or prediction of results in any future engagement, which will depend on the specific circumstances of that engagement.
You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on the Site.
8. Enquiries, applications and submissions
Where you send us an enquiry, an application or other material through the Site or through the contact channels published on it, you confirm that the information you provide is accurate and that you are entitled to provide it to us. We handle personal data contained in such submissions in accordance with our Privacy Policy.
Submitting an enquiry does not create any contract or engagement between us. No contract for services comes into existence until agreed in writing and signed by both parties. Submitting an application does not oblige us to consider it, to respond, or to offer any role or engagement.
We do not accept unsolicited proposals, concepts, ideas or business plans, and we ask that you do not send them. Where you nonetheless send us material that is not part of a genuine enquiry about our services or a genuine application, you agree that we may use, reproduce and disclose that material without restriction, without obligation of confidence and without payment to you, and you acknowledge that we may already be working on similar or identical ideas independently.
9. Acceptable use
You may use the Site only for lawful purposes. You must not use the Site in any way that breaches any applicable local, national or international law or regulation, or in any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect.
You must not use the Site to send, knowingly receive, upload, download or otherwise transmit any material that is defamatory, obscene, offensive, threatening, harassing, discriminatory, or that infringes the rights of any person. You must not use the Site to transmit unsolicited or unauthorised advertising or promotional material, or to impersonate any person or misrepresent your identity or affiliation.
You must not reproduce, duplicate, copy, resell, scrape, harvest, mine or otherwise systematically extract any part of the Site or its content in breach of these Terms of Use. You must not use any automated system, robot, spider or similar tool to access the Site in a manner that sends more request messages to our infrastructure than a human could reasonably produce in the same period, nor use content from the Site to train machine learning or artificial intelligence systems without our prior written permission.
You must not attempt to gain unauthorised access to the Site, to the server on which the Site is stored, or to any server, computer or database connected to the Site. You must not attack the Site by means of a denial of service attack or a distributed denial of service attack, and you must not knowingly introduce viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful.
We will report any breach of this section to the relevant law enforcement authorities and we will co-operate with those authorities, including by disclosing your identity to them. In the event of such a breach, your right to use the Site ceases immediately.
10. Viruses and security
We do not guarantee that the Site will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform to access the Site, and you should use your own virus protection software.
11. Linking to the Site
You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists, and you must not frame the Site on any other site or create a link to any part of the Site other than the home page without our prior written permission.
The website from which you link must comply with the standards set out in these Terms of Use. We reserve the right to withdraw linking permission without notice.
12. Third-party links and content
Where the Site contains links to other sites, platforms and resources provided by third parties, those links are provided for your information only and should not be interpreted as approval by us of those sites or of any information you may obtain from them. We have no control over the contents of those sites or resources and accept no responsibility or liability for them, or for any loss or damage arising from your use of them.
13. Our liability
Nothing in these Terms of Use excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
To the fullest extent permitted by law, we exclude all conditions, warranties, representations and other terms which might otherwise be implied by statute, common law or otherwise in relation to the Site and its content.
We will not be liable to any user for any loss or damage, whether in contract, tort including negligence, breach of statutory duty or otherwise, arising under or in connection with the use of, or inability to use, the Site, or the use of or reliance on any content displayed on it. In particular, we will not be liable for loss of profits, loss of sales, revenue or business, loss of anticipated savings, business interruption, loss of business opportunity, goodwill or reputation, or any indirect or consequential loss or damage.
Where you are a consumer under the law of your jurisdiction, and that law grants you rights that cannot lawfully be excluded, nothing in these Terms of Use affects those rights.
14. Indemnity
You agree to indemnify and hold us harmless against any claims, liabilities, damages, losses and reasonable costs, including legal fees, arising out of or in connection with your breach of these Terms of Use, your misuse of the Site, or your infringement of the rights of any third party in connection with your use of the Site.
15. Suspension and termination
We may, at our sole discretion and without notice, restrict, suspend or terminate your access to all or any part of the Site where we consider that you have breached these Terms of Use, or where we consider it necessary to protect the Site, our business, our clients or other users. The provisions of these Terms of Use which by their nature are intended to survive termination, including those relating to intellectual property, liability, indemnity and governing law, will continue to apply.
16. General
If any provision of these Terms of Use is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision will be severed to the minimum extent necessary and the remaining provisions will continue in full force and effect.
Our failure or delay in enforcing any provision of these Terms of Use will not constitute a waiver of that provision or of any other provision, and no single or partial exercise of any right will prevent any further exercise of that right.
We may transfer or assign our rights and obligations under these Terms of Use to another organisation, including in connection with a sale or reorganisation of our business. You may not transfer or assign your rights or obligations under these Terms of Use without our prior written consent.
These Terms of Use, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and us in relation to your use of the Site, and supersede any previous arrangement or understanding between us in relation to it.
A person who is not a party to these Terms of Use has no right to enforce any of their provisions.
17. Governing law and jurisdiction
These Terms of Use, their subject matter and their formation, and any non-contractual obligations arising out of or in connection with them, are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai, together with the regulations of the Meydan Free Zone Authority to the extent applicable.
You and we agree that the courts of Dubai, United Arab Emirates, will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms of Use or your use of the Site. Where you are a consumer resident in a jurisdiction whose law grants you the right to bring proceedings in your local courts, nothing in this section removes that right.
